1. Introduction and Acceptance

Welcome to Traceback, a time management and tracking service developed and operated by Dharma Web Studio (hereinafter, "we", "our" or "the Provider"), with Tax ID ES39425922N.

By accessing, registering, or using Traceback (hereinafter, "the Service", "the Application" or "the Platform"), you (hereinafter, "the User" or "you") expressly and without reservation accept these Terms and Conditions (hereinafter, "the Terms"). If you do not agree with any part of these Terms, you should not use the Service.

2. Service Description

Traceback is a web application designed to facilitate time tracking and management for work, projects, and tasks. The Service includes, but is not limited to:

  • Time recording and tracking (frames/time records)
  • Project and team management
  • Report generation and exports
  • Integration with third-party services (such as Asana)
  • User and collaborative team management
  • Personal preference configuration

2.1 Service Availability

The Service is currently offered free of charge through a waitlist system and requests that must be accepted by the Provider. We reserve the right to:

  • Modify, suspend, or discontinue the Service at any time
  • Implement fees or subscription plans in the future, with prior notice
  • Limit the number of users, features, or storage capacity
  • Change or update features according to business needs

2.2 Beta Phase and Waitlist

The User acknowledges that the Service may be in development, testing, or continuous improvement phase (beta). Access may be restricted through a waitlist and requires express approval from the Provider.

3. User Registration and Account

3.1 Registration Requirements

To use the Service, you must:

  • Be at least 18 years old or the legal age in your jurisdiction
  • Provide truthful, accurate, and up-to-date information during registration
  • Maintain the confidentiality of your access credentials
  • Immediately notify any unauthorized use of your account

3.2 Account Responsibility

You are solely responsible for:

  • All activities performed under your account
  • Keeping your access credentials secure
  • The truthfulness and legality of content you publish or store
  • Complying with applicable laws in your jurisdiction

3.3 Account Suspension and Termination

We reserve the right to suspend or cancel your account if:

  • You violate these Terms or any applicable law
  • You provide false or misleading information
  • You engage in fraudulent or malicious activities
  • You do not access the Service for an extended period
  • For security, maintenance, or business reasons

4. Acceptable Use of the Service

4.2 Prohibited Use

It is expressly prohibited to:

  • Perform reverse engineering, decompilation, or source code extraction
  • Send malware, viruses, or malicious code
  • Intentionally overload the Service infrastructure

  • Violate intellectual property rights of the Provider or third parties
  • Impersonate other users or entities
  • Interfere with the proper functioning of the Service

5. Intellectual Property

5.1 Service Ownership

All rights, titles, and interests in the Service, including but not limited to:

  • Source code, design, and software architecture
  • "Traceback" trademark and associated logos
  • Documentation, texts, graphics, and interfaces
  • Features, algorithms, and processes

Are the exclusive property of Dharma Web Studio or its licensors. No part of these Terms grants a license or ownership right over the Service beyond authorized use.

5.2 Limited Use License

You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Service in accordance with these Terms. This license does not include:

  • Right to sublicense, sell, or distribute the Service
  • Right to modify, adapt, or create derivative works
  • Right to use the Service in competing products or services

5.3 User Content

You retain all rights to the data and content you enter into the Service (projects, time records, descriptions, etc.). By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to:

  • Store, process, and display your content within the Service
  • Make backups and ensure Service availability
  • Generate aggregated and anonymous statistics for product improvement

6. Privacy and Data Protection

The processing of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms. By using the Service, you accept the data processing described in that policy and in accordance with the General Data Protection Regulation (GDPR) and applicable Spanish legislation.

7. Limitation of Liability and Warranties

7.1 No Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranty of uninterrupted, timely, or error-free operation
  • Warranty of accuracy, reliability, or completeness of results
  • Warranty of defect or error correction
  • Warranty of absolute security or absence of vulnerabilities

7.2 Limitation of Liability

To the maximum extent permitted by applicable law, Dharma Web Studio and its directors, employees, or collaborators SHALL NOT BE LIABLE for:

  • Loss of data, profits, revenue, or anticipated savings
  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of business opportunities or reputation
  • Interruption of activities or damage to computer systems
  • Any damages arising from use or inability to use the Service

This limitation applies even if we have been advised of the possibility of such damages and regardless of the legal basis of the claim (contract, tort, negligence, etc.).

7.3 Maximum Liability

In any case, our total aggregate liability shall not exceed the amount paid by you to the Provider in the last 12 months, or €100 if the Service is free, whichever is greater.

7.4 Disclaimer for Third-Party Content

We are not responsible for the content, accuracy, legality, or consequences arising from:

  • Integrations with third-party services (Asana, etc.)
  • Actions of other users within shared teams
  • External links or references to third-party resources

8. Availability and Maintenance

8.1 Service Interruptions

We do not guarantee that the Service will be continuously available or error-free. The Service may experience interruptions due to:

  • Scheduled or emergency maintenance
  • Technical failures, network or infrastructure problems
  • Software updates or migrations
  • Force majeure, cyber attacks, or causes beyond our control

8.2 Backups

While we perform regular backups, we recommend that you maintain your own copies of critical data. We do not guarantee data recovery in case of loss, corruption, or deletion.

9. Modifications to the Service and Terms

9.1 Service Modifications

We reserve the right to:

  • Add, modify, or remove features at any time
  • Update the interface, design, or workflows
  • Modify usage limits, capacity, or performance

We will make reasonable efforts to notify significant changes, but we are not obligated to do so.

9.2 Terms Modifications

We may modify these Terms at any time. Modifications will take effect:

  • Immediately upon publication in the Service for minor changes
  • 30 days after notification for material changes

Your continued use of the Service after changes to the Terms constitutes acceptance of such changes. If you do not agree, you must stop using the Service.

10. Termination

10.1 Termination by User

You may cancel your account at any time from your profile settings or by contacting us directly.

10.2 Termination by Provider

We may suspend or terminate your access immediately, with or without prior notice, for:

  • Violation of these Terms
  • Suspicious, fraudulent, or illegal activity
  • Request from competent authorities
  • Cessation of Service operations
  • Any other reason at our reasonable discretion

10.3 Effects of Termination

Upon termination:

  • Your access to the Service will cease immediately
  • We may delete or retain your content according to our retention policy
  • Provisions that by nature must survive (limitations of liability, intellectual property, jurisdiction) will continue in effect
  • We will have no obligation to refund for unused periods (if applicable)

11. Indemnification

You agree to indemnify, defend, and hold harmless Dharma Web Studio, its directors, employees, agents, and affiliates from any claim, loss, liability, damage, cost, or expense (including reasonable legal fees) arising from:

  • Your use of the Service or breach of these Terms
  • Violation of third-party rights, including intellectual property or privacy
  • Your content or activities under your account
  • Disputes with other users or third parties related to the Service

12. Applicable Law and Jurisdiction

12.1 Applicable Legislation

These Terms are governed and interpreted in accordance with the laws of Spain, without regard to conflicts of legal principles.

12.2 Jurisdiction

For any dispute arising from these Terms or use of the Service, the parties expressly submit to the exclusive jurisdiction of the Courts and Tribunals of the city corresponding to the Provider's address in Spain, with express waiver of any other jurisdiction that may correspond to them.

12.3 Dispute Resolution

Before initiating any judicial proceeding, the parties agree to attempt to resolve any dispute amicably through good faith negotiation for a period of 30 days.

13. General Provisions

13.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Dharma Web Studio regarding the Service and supersede any prior agreement, oral or written.

13.2 Severability

If any provision of these Terms is deemed invalid or unenforceable, such provision will be modified or deleted to the extent necessary, and the remaining provisions will continue in full force and effect.

13.3 Waiver

No waiver of any term shall be effective unless made in writing. Failure to exercise or enforce any right shall not constitute a waiver of such right.

13.4 Assignment

You may not assign, transfer, or sublicense these Terms without our prior written consent. We may assign these Terms at any time without restrictions.

13.5 Headings

Section headings are for convenience only and do not affect the interpretation of these Terms.

13.6 Language

In case of translation, the Spanish version shall prevail in case of conflict or discrepancy.
